Protected Classes

Some Examples of Potential Fair Housing Violations

It may be a violation of fair housing laws for a real estate professional to, among other things:

  • Refuse to show, rent, or sell housing because of a person's membership in a protected class.
  • Make housing unavailable, or set different terms, conditions, or privileges, based on a protected class.
  • Refuse to accept a lawful source of income, such as a housing voucher or rental-assistance program.
  • Steer prospective buyers or renters toward or away from particular neighborhoods.
  • Make, print, or publish any statement or advertisement that indicates a preference, limitation, or discrimination.
  • Refuse to make a reasonable accommodation or permit a reasonable modification for a person with a disability.

Reasonable Accommodations for Persons with Disabilities

People with disabilities have the right to request reasonable accommodations in a housing provider's rules, policies, practices, or services, and reasonable modifications to a dwelling, when needed to have equal opportunity to use and enjoy a home. Common examples include an assistance or service animal in a “no-pet” building, an accessible parking space, or permission to install a grab bar. If You Believe You Have Experienced Discrimination

If you believe you have been the victim of housing discrimination, you may file a complaint with the New York State Division of Human Rights (dhr.ny.gov) or the New York State Department of State, Division of Licensing Services.
